Terms of Service

1. Acceptance
By creating an account or using OpenAnalyticsAPI, you agree to these Terms of Service. If you do not agree, do not use the service.
2. Service
OpenAnalyticsAPI provides web and mobile analytics services. We reserve the right to modify or discontinue the service with reasonable notice.
3. Acceptable use
You may not use OpenAnalyticsAPI to:
- Track users without appropriate notice or consent where required by law
- Violate applicable privacy laws (GDPR, CCPA, etc.)
- Engage in fraud, spam, or abuse
- Circumvent event quotas through artificial inflation
- Use the service for illegal purposes
Session Replay restrictions. When using the optional Session Replay feature, you must not configure replay to capture:
- Passwords or any authentication credentials
- Payment card data, CVV, or bank account numbers
- Health data, government IDs, or other special-category personal data under GDPR Art. 9
- Content from authenticated areas of third-party services
By default, all input fields are masked at capture time on the user's browser. You are responsible for marking any additional sensitive content with data-oa-mask before enabling replay on a page that may contain such data. See the Privacy Policy for details.
4. Data ownership
You retain ownership of all analytics data collected through your projects. We act as a data processor on your behalf. You are the data controller and responsible for compliance with applicable privacy laws.
5. Billing
Paid plans are billed monthly or annually in advance. Overages on the free tier result in event blocking (no surprise charges). Refunds are handled case-by-case — contact support.
6. Uptime and SLA
We target 99.9% uptime for the ingest and dashboard. No formal SLA is provided on Free or Pro tiers. Business tier includes 24-hour response SLA. Enterprise includes a custom SLA.
7. Limitation of liability
To the maximum extent permitted by law, OpenAnalyticsAPI shall not be liable for indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the amount you paid in the past 12 months.
8. Governing law
These terms are governed by the laws of the Czech Republic. Disputes shall be resolved in Czech courts.
